Terms of Service

1. Agreeing to these terms

Using the Service means agreeing to what is written here. If you do not agree, please do not use it. These terms apply whether you are reading a page, running a session as a guest, or holding an account.

2. What the Service is

We build instruments for exploring perception, and we run research on what they record. The Field carries those instruments on a phone. The website carries our writing, our research, our contact routes, and browser versions of some of the same tools.

The instruments use protocols from the published literature, including work from SRI International and the Rhine Research Center, and cryptographically secure random number generation.

3. Accounts and age

The app. You need an account to use The Field. You give a date of birth when you sign up, it is written once and cannot be edited afterwards, and it decides which parts of the app you can reach. You must be at least 13 to hold an account. Some parts are for adults only, and our server decides that from the date on the account rather than from anything the app sends.

The website. Public registration is not open. Where a browser tool runs without an account, an anonymous identifier is kept on your own device to hold your progress.

You are responsible for:

• Keeping your passphrase and your recovery codes to yourself.
• What happens under your account.
• Telling us promptly if you think somebody else is using it.

Your recovery codes are shown once, each works a single time, and if your account has no email address they are the only way back in. We cannot recover an account without them.

4. What the app costs

The Field is free to download and free to use. If we add a paid tier later, its price and its terms will be shown in the App Store or Google Play before you buy anything, and the purchase will go through Apple or Google rather than through us. Nothing in the app takes a payment today.

5. Memberships and payments on the website

We offer paid programmes through the website, including the Founding Circle and in-person retreats. Buying one means agreeing to that programme’s own terms, given to you at the time, alongside these.

Payment. Handled entirely by Stripe under its own privacy policy and PCI-DSS compliance. We do not see, store or transmit your card number.

Refunds. Each programme states its own refund and cancellation terms at signup. Ask us at hello@thetelepathycenter.com about an existing booking.

Prices. They can change. A change never reaches back for something already paid for.

6. Research participation is a separate yes

Using the instruments does not put your sessions into the research. Contributing is asked for on its own screen, in its own words, and only adults can agree to it. You can practise for as long as you like without ever answering that screen.

If you do consent:

• Your sessions are filed under a research pseudonym that is not linked to your name or your email address.
• Consent applies from the moment you give it. It does not reach back for sessions you already ran.
• Withdrawing stops future sessions being included. It does not reach back for sessions already sealed.
• What we publish is aggregate statistics. Individual sessions are never presented as belonging to a person.

7. Research integrity

Every session is hashed into an append-only chain on our servers when it is sealed, so that a run cannot be quietly altered or removed afterwards. The hash covers the session record and carries no identity.

We intend to anchor those hashes to a public blockchain and to publish attested aggregate results. That work is not running yet, so please do not read these terms as a claim that it is. When it starts, what is published will be anonymised and will contain nothing that identifies a person.

8. What we do not promise

The Service is provided as it is, without warranties of any kind, express or implied. That includes warranties of merchantability, of fitness for a particular purpose, of any specific result, and of the accuracy of any statistical analysis for any purpose of yours.

We make no claim that ESP or psychic ability is real. Our instruments measure how far a run sits from chance. What that means is for you and for the wider scientific community to argue about, and we would rather you did.

9. Limits on our liability

So far as the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, including lost data, lost profits, personal or psychological distress, decisions you made on the strength of a session result, or an interruption of the Service.

Our total liability for any claim will not exceed what you paid us in the twelve months before it arose. Nothing here limits liability that cannot be limited by law, and some countries do not allow these exclusions, in which case they do not apply to you.

10. How you may not use it

Please do not:

• Falsify or manipulate session results.
• Interfere with the Service or with our servers.
• Reach for data belonging to anybody else.
• Run scripts or bots against it without asking us first.
• Break the law with it.
• Harass, abuse or harm another person through it.
• Misrepresent who you are or who you work for.

We may investigate and act on any of these, which can include suspending or closing an account.

11. Your licence to the app

We grant you a personal, non-transferable, non-exclusive licence to use The Field on devices you own or control, under the rules of the store you got it from. You may not copy it, sell it, rent it, reverse engineer it, or strip anything out of it, except where the law says you may whatever we write here.

This licence is between you and us. Apple and Google are not parties to it and are not responsible for the app, though Apple may enforce it as a third-party beneficiary of your agreement with us.

12. Who owns what

The Service, and its content, features and design, belong to The Telepathy Center and are protected by copyright, trademark and other law.

Your sessions are yours. Using the Service grants us a non-exclusive, royalty-free licence to use them in the anonymised, aggregate way section 6 describes, and only if you consented under that section.

Some parts of our tools may be released under open-source licences, and those licences govern those parts.

13. Ending it

You can delete your account at any time, from inside the app or from our account deletion page. What that removes and what it keeps is set out there and in the privacy policy.

We may suspend or close an account that breaks these terms. Where we do, you can ask for a copy of your data first. The parts of these terms that should outlive the account survive it, including ownership, the disclaimers and the liability limits.

14. Changes

We may change these terms. When we do, the date at the top changes, and for anything material we post a notice on the site and email account holders whose rights the change affects. Carrying on using the Service after that means accepting the new terms.

15. Law and disputes

These terms are governed by the law of the jurisdiction in which The Telepathy Center, Inc. operates, without regard to conflict of law rules. We would rather settle a dispute by talking. If that fails, disputes go to binding arbitration under the applicable rules, except where the law of your own country gives you a right you cannot sign away.

16. Severability

If any part of these terms turns out to be unenforceable, that part is narrowed or dropped only so far as needed, and the rest stands.
